WAIVER AND DISCLAIMER

THE SALT SUITE’S SERVICES AND ACTIVITIES ARE PROVIDED ”AS-IS, WHERE IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE. All products, services and activities offered by The Salt Suite, including written information, labels, brochures and flyers as well as information provided orally or in any other medium of communication, have not been evaluated or approved by the Food and Drug Administration and are not intended to diagnose, treat, cure or prevent any disease. For all your health concerns, please consult an appropriately licensed healthcare provider. The Salt Suite recommends that you receive medical clearance prior to engaging in offered services and activities. Halotherapy is not recommended in the following cases: tuberculosis, fever, contagious conditions, severe heart disorders, cancer, advanced pregnancy, haemoptysis and acute state of respiratory attack. Do not stop medication without first consulting with your doctor. Halotherapy is NOT a substitute for any conventional medication. If you have questions about halotherapy check with your doctor before proceeding.

I, the undersigned, acknowledge and agree, for myself, and for my minor children, that the use of the Facilities and Equipment and participation in the activities have INHERENT RISKS including, but not limited to, injury to person, including death, and damage to personal property, including, but not limited to, electronics, compressed air cylinders (including oxygen tanks), items containing metal and components related to the foregoing personal property. I FREELY AND VOLUNTARILY ASSUME COMPLETE RESPONSIBILITY for these risks and for the injuries or damages that may occur as a result; whether foreseeable or not. I represent that I, and my minor children, are in good physical condition and have no disability, illness, or other condition that would prevent me from participating in the Activities without injury or impairment of health, and that I have consulted a physician concerning participation in the Activities.

IN CONSIDERATION OF MY, AND/OR MY MINOR CHILDREN, OBSERVING OR USING THE FACILITIES, OR EQUIPMENT AND/OR PARTICIPATING IN THE ACTIVITIES, I HEREBY AGREE TO RELEASE FROM ALL LIABILITY, DISCHARGE, AND PROMISE NOT TO SUE (I) THE SALT SUITE; (II) ANY OTHER PARTICIPANT, VISITOR, OR PERSON PRESENT IN OR USING THE FACILITIES AND/OR EQUIPMENT; (III) THE DESIGNERS, MANUFACTURERS OR INSTALLERS OF THE FACILITIES AND/OR EQUIPMENT; AND (IV) THE OWNER AND/OR LANDLORD, AND THEIR OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, VOLUNTEERS, AND AGENTS OF THE FACILITIES AND/OR EQUIPMENT. THIS AGREEMENT RELEASES THE AFOREMENTIONED PERSONS FROM ANY LIABILITY TO ME AND MY MINOR CHILDREN, OUR HEIRS, NEXT OF KIN, SUCCESSORS, ASSIGNS, AND PERSONAL REPRESENTATIVES, FOR ANY LOSSES OR DAMAGES OR CLAIMS OR DEMANDS ARISING OUT OF PERSONAL INJURIES OR DAMAGE TO MY PERSONAL PROPERTY. If any provision of this Agreement is held invalid, the invalidity shall not affect other provisions of the Agreement which can be given effect without the invalid provisions, and to this end the provisions of the Agreement are to be severable. This Agreement shall be governed by the laws of the State of New Jersey.

The Salt Suite is not held liable for any and all personal equipment such as iPhones, ipads, or any personal electronics that are brought into the salt rooms. It is your responsibility for any damages incurred at The Salt Suite. In consideration of my observing or using the Facilities, or Equipment or participating in the activities, I agree to indemnify and hold harmless the persons RELEASED and DISCHARGED by me from any loss, liability, damages or cost, including reasonable attorneys’ fees, that they may incur due to the presence of any claims or actions by me, my minor children, or by my heirs, next of kin, assigns, or personal representatives.

I AGREE AND UNDERSTAND THAT THIS WAIVER AND DISCLAIMER WILL EXTEND TO ALL CLAIMED WRONGFUL ACTS OF THE RELEASED PARTIES TO THE GREATEST EXTENT ALLOWED UNDER THE LAWS OF THE STATE OF NEW JERSEY, INCLUDING THE NEGLIGENCE OR MISCONDUCT OF THE RELEASED PARTIES. DEFINITIONS 1. The term ”The Salt Suite” means The Salt Suite, LLC, Salt Suite Franchising, LLC, any franchisee of The Salt Suite, LLC OR Salt Suite Franchising, LLC, and their officers, directors, managers, owners, employees, agents, suppliers, affiliates, subsidiaries, successors and/or assigns. 2. The term “Facilities” means the physical premises where The Salt Suite conducts its business. 3. The term “equipment” shall mean the devices or other equipment in the activities. 4. The term “Activities” shall mean salt therapy, halotherapy, and any other services offered by The Salt Suite.

HAVE READ THIS AGREEMENT THOROUGHLY AND UNDERSTAND THE TERMS. NO ORAL REPRESENTATIONS OR STATEMENTS OR INDUCEMENTS HAVE BEEN MADE TO ME THAT CHANGE, ALTER OR MODIFY ANYTHING WITHIN THE WRITTEN AGREEMENT.
